Judge lets NAACP Clean Air Act suit over xAI's Memphis turbines proceed

A federal judge, Debra M. Brown, denied xAI's motion to dismiss the NAACP's suit on Oct. 31, per TechCrunch. The suit alleges xAI ran at least 35 combustion turbines at its Colossus data center near Memphis without required air permits. The judge rejected xAI's claims that the turbines are mobile sources and that the plaintiffs lack standing. TechCrunch reports no comment from xAI or SpaceX.
